Artikel 1: Akkoordverklaring & Definities

Definities

Centrum Voor Afstandsonderwijs: Onderdeel van de Ondernemersschool bv, gevestigd in de Druivenstraat 25-31, 4816 KB BREDA, met telefoonnummer 03/292.33.30 en met btw-nummer NL853617582B01, verder genoemd ‘de School’.

Cursist: (i) De (rechts)persoon die zich bij de School inschrijft voor of een offerte ontvangt voor een professionele opleiding. Deze (rechts)persoon heeft een professioneel doel voor ogen, namelijk het volgen van een beroepsopleiding. (ii) De particulier/consument die niet handelt in de uitoefening van een beroep of bedrijf en louter omwille van niet-professionele doeleinden een hobbycursus volgt.

Cursus: Een door de School verzorgde professionele (thuis)studie, cursus, dan wel enige vorm van cursus die opleidt tot een beroep. Een professionele cursus kan onderverdeeld zijn in één of meerdere opleidingsmodule(s) en kan verspreid zijn over meerdere opleidingsjaren.

Akkoordverklaring

Het examenreglement geldt voor alle cursisten van het Centrum Voor Afstandsonderwijs. Elke cursist die zich inschrijft voor een opleiding verklaart zich uitdrukkelijk akkoord met dit reglement. Voor meer informatie over het online (her)examen, raadpleeg de rubriek 'Examen en Diploma' bij de veelgestelde vragen.

Artikel 2. Getuigschriften

Voor cursussen waarvoor een examen voorzien is kunnen cursisten een diploma, attest of certificaat behalen mits zij slagen voor het examen. Het type getuigschrift dat men behaalt hangt af van de cursus. Deze informatie is te allen tijde beschikbaar voor de cursist op de site. De cursist verklaart dat hij/zij hiervan op de hoogte is bij de inschrijving voor een cursus.

Elk examen wordt volgens de hierna bepaalde regels zo georganiseerd, dat de cursisten de kans krijgen te bewijzen dat zij beschikken over de competenties die vereist zijn voor het professionele doeleinde dat zij voor ogen hebben.

Artikel 3. Tijd en plaats van de examens

De cursist beslist zelf wanneer men het online examen aflegt en kan dit plannen via zijn/haar online studentenprofiel. Dit dient minstens een week op voorhand te gebeuren. De aanvraag wordt binnen de 48 uur verwerkt en is definitief wanneer de cursist een bevestiging ontvangt van de School. In de bevestiging vindt men alle details van het examen: de datum, het uur en eventuele benodigdheden.

Tot vijf jaar na inschrijving voor de cursus heeft de cursist het recht om examen af te leggen. Om het examen af te leggen wordt geen examengeld gevraagd.

Artikel 4. Examens voor een beschermd beroep

Bij een aantal cursussen zal de cursist examen afleggen bij de Centrale Examencommissie. Dit is het geval bij:

  • Gereglementeerde beroepen In dat geval legt de cursist examen af bij de Centrale Examencommissie in Brussel, voor het behalen van het vestigingsattest waarmee men gerechtigd is dit beroep uit te oefenen.
  • Secundair onderwijs Hiervoor legt de cursist examens af bij de Examencommissie van het Secundair Onderwijs van de Vlaamse Gemeenschap, zodat men een officieel diploma secundair onderwijs behaalt.

Als voorbereiding op de examens bij de Centrale Examencommissie kan de student een proefexamen bij de School afleggen. Voor dit proefexamen gelden dezelfde voorwaarden als een standaardexamen bij de school.

Artikel 5. Voorwaarden om aan examens deel te nemen

§1. Wanbetaling

Cursisten kunnen slechts deelnemen aan een examen als ze het verschuldigde studiegeld betaald hebben.

§2. Verplichtingen per opleidingsonderdeel

De deelname aan een examen kan aan bepaalde voorwaarden onderworpen zijn, zoals de tijdige indiening van werkstukken. De School kan bepalen dat cursisten die niet aan de gestelde voorwaarden voldoen, een nul-score of een "niet geslaagd" krijgen voor het betrokken opleidingsonderdeel of voor een deel ervan.

§3. Controle van de identiteit

Op het examen moeten de cursisten hun identiteit kunnen bewijzen. Cursisten moeten hun identiteitskaart en cursistennummer voorleggen. De aanwezigheid van de cursisten wordt ook geregistreerd. Als de cursist geen geldig identiteitsbewijs kan voorleggen, krijgt de cursist de status van “niet deelname” (ND)

Artikel 6. Inhaalexamens

Cursisten die voor een examen zijn ingeschreven maar hier niet aan kunnen deelnemen, moeten dit tenminste één werkdag op voorhand met een geldig medisch attest of de nodige bewijsstukken bij overmacht aan de School communiceren. Vervolgens kan de cursist met de School een inhaalexamen inplannen op later tijdstip. Dit kan via het online studentenplatform.

Artikel 7. Inleveringstermijn van werkstukken

Wanneer voor de indiening van een werkstuk een bepaalde inleveringstermijn is vastgelegd, maar cursisten om gegronde redenen menen deze termijn niet te kunnen respecteren, moeten zij vóór de vastgelegde indiendatum contact opnemen.

De School kan bepalen dat, indien de inleveringstermijn niet gerespecteerd wordt, het werkstuk als niet-ingeleverd wordt beschouwd en de cursisten voor deze opdracht een nulscore of een beoordeling "niet-afgelegd" krijgen.

Artikel 8. Examenvorm en examenduur

Cursisten leggen hun examen standaard online af. De modaliteiten van het examen of evaluatievorm worden vooraf aan de cursisten meegedeeld. Deze worden bepaald op basis van de te beoordelen competenties. Naast digitale vragen, kunnen examens bestaan uit mondelinge of schriftelijke vragen, het maken van een praktische proef of uit een portfolio met interview, afhankelijk van de opleiding. Tenzij aan de cursisten uitdrukkelijk anders is meegedeeld, gebeurt elk examen zonder het gebruik van enig schriftelijk of digitaal naslagwerk.

Artikel 8.1 Giscorrectie

Bij de digitale vragen (online examen) worden de antwoorden automatisch door het systeem verbeterd met een toepassing van giscorrectie. Hierbij wordt voor elk correct antwoord 1 punt toegekend. Het niet beantwoorden van vragen resulteert in geen punten. Bij een fout antwoord wordt de score verminderd op basis van het aantal antwoordmogelijkheden ten belope van 1/ (aantal antwoordalternatieven – 1). Dit betekent dat het willekeurig raden van antwoorden wordt bestraft. Wanneer de student bijvoorbeeld een vraag met vier antwoordmogelijkheden fout beantwoordt, wordt er -1/3 punt afgetrokken. Bij een vraag met drie antwoordmogelijkheden is dat -1/2 punt. Indien het om een juist/fout-vraag gaat, wordt er 1 punt afgetrokken. 

Artikel 9. Audio en video opnames tijdens het examen

De student gaat ermee akkoord dat er tijdens het examen video- en audio-opnames gemaakt worden om bewijsmateriaal ter beschikking te hebben bij een klacht of beroepsprocedure. De school kan de opnames ook gebruiken om de interne kwaliteitszorg te bewaken.

Artikel 10. Onregelmatigheden

Elk gedrag van een cursist da een correcte evaluatie verhindert omtrent de beheersing van competentiedoelen (bv spieken, plagiaat …) wordt als onregelmatigheid beschouwd en geeft de School het recht om het examen stop te zetten en automatisch een nul-score toe te kennen aan de cursist. De cursist verliest ook het recht om voor het betrokken examen, herexamen af te leggen.

Artikel 11. GSM

Tijdens het examen dient de cursist zijn/haar GSM, smartphone of ander elektronisch toestel uit te schakelen, tenzij het gebruik van dergelijk toestel uitdrukkelijk is toegestaan door de vakdocent van de cursus waarvoor men examen aflegt. Indien de cursist zich niet aan deze regel houdt, heeft de School het recht om het examen stop te zetten en automatisch een nulscore toe te kennen aan de cursist. De cursist verliest dan voor dit examen het recht op herexamen.

Artikel 12. Beoordelingsschaal

Elk opleidingsonderdeel wordt op 100 procent beoordeeld. Het resultaat wordt uitsluitend in procent uitgedrukt. De School kan beslissen dat voor een opleidingsonderdeel of een deel ervan een beoordeling plaatsvindt onder de vorm van een geslaagd/niet-geslaagd-beslissing.

Eventuele deelcijfers worden door de vakdocent of, door overeenkomst tussen verschillende vakdocenten omgezet in één eindcijfer op 100 procent.

Artikel 13. Criteria voor het slagen voor een opleidingsonderdeel

Cursisten slagen voor een opleidingsonderdeel als zij ten minste 60% of de beoordeling "geslaagd" behalen voor de beheersing van de bevraagde competentiedoelen. Bestaat de opleiding uit een deel theorie en een deel praktijk? Dan dient de cursist op beide onderdelen 60% te scoren.

Artikel 14. Criteria voor het slagen voor een allround opleiding

De allround opleidingen bestaan uit meerdere opleidingsonderdelen. Om voor een allround opleiding te slagen dient de cursist minstens 60% te behalen voor de beheersing van de bevraagde competentiedoelen van elk individueel opleidingsonderdeel. Per opleidingsonderdeel krijgt de cursist een diploma mits hij/zij slaagt voor het examen. Als de cursist voor alle opleidingsonderdelen geslaagd is, behaalt deze tevens het allround diploma.

Artikel 15. Niet-deelname aan een examen

Als cursisten niet deelnemen aan een examen, wordt dat examen beoordeeld als "niet-deelgenomen" (ND).

Artikel 16. Verlies van een examen

In het zeer uitzonderlijke geval dat de onderwijsinstelling of de docent het examen verliest en de School verantwoordelijk is voor het verlies van het examen dan wordt er in onderling overleg met de cursist of de klas een nieuwe examenmoment ingepland. De modaliteiten van het nieuwe examen worden besproken met de betrokken cursist of klas.

Artikel 17. Bekendmaking resultaten

De leden van de examenjury en alle personen die op de deliberatie aanwezig zijn, zijn gehouden aan een absolute geheimhouden over de beraadslaging en de stemmingen. De vakdocenten delen zo spoedig mogelijk na het examen de resultaten mee via het studentenplatform. Je kan dus via het studentenprofiel onmiddellijk je punten bekijken. Online examenresultaten verschijnen meteen nadat studenten het examen hebben ingediend. Het diploma wordt daarna zo snel mogelijk per post opgestuurd. De School is niet aansprakelijk voor enige vertraging van de post. Dit neemt soms tot 2 tot 3 weken in beslag.

Artikel 18. Bespreking van de resultaten en recht op feedback

De cursisten hebben het recht om samen met de docent hun examen in te kijken. Zij moeten een feedbackmoment aanvragen via het secretariaat van de School als hier gegronde redenen voor bestaan. Niets uit het examen mag op welke manier dan ook gekopieerd worden en/of meegenomen worden uit het inzagelokaal.

De School kan in onderling overleg beslissen om een feedbackmoment in te plannen als de leerling niet geslaagd is voor het examen na meerdere pogingen.

Artikel 19. Bezwaartermijn

Indien de student niet akkoord is met zijn/haar eindresultaat dan beschikt hij/zij over een bezwaartermijn van veertien kalenderdagen (die ingaat vanaf het moment dat de examenresultaten beschikbaar zijn voor de student) om een aangetekende klacht in te dienen bij de School. Deze klacht wordt dan voorgelegd aan een jury bestaande uit een lid van de directie, de administratie en een hoofddocent. De beslissing van de jury kan leiden tot een gemotiveerde afwijzing van de klacht, een bevestiging van de oorspronkelijke beslissing of een herziening van de oorspronkelijke beslissing.

Artikel 20. Herexamens

Cursisten kunnen ten vroegste na 30 dagen herexamen afleggen zoveel zij willen zolang dit de periode van 5 jaar niet overschrijdt (geteld vanaf inschrijvingsdatum) en tenzij de School heeft vastgesteld dat de cursist heeft gespiekt of zich niet aan het examenreglement heeft gehouden. Wanneer de cursist na twee herexamens nog steeds niet geslaagd is, kan de School in overleg gaan met de cursist om te kijken hoe deze zijn/haar leermethode dient aan te passen.

Article 1: Statement of approval & definitions

Statement of approval

The examination regulations apply to all students of the Centre for Distance Learning. Every student who registers for a course agrees with these regulations.

Definitions

Centre for Distance Learning vzw: Part of the Ondernemersschool bv, located at Marksingel 2A, 4811 BREDA NV, with telephone number 03 / 292.33.30 and with VAT number NL853617582B01, hereinafter referred to as “the school”.

Student: (i) The person or legal entity who registers with the school or receives a quote for professional training. This entity has a professional goal in mind, namely enrolling in a course. (ii) The private individual/consumer who does not exercise a profession and follows a hobby course for non-professional purposes.

Course: A professional (home) study, course or any form of education provided by the school that leads to a profession. a professional course can be divided into one or more training module(s)and can be spread over several training periods/years.

Article 2: Certificates

For courses where an exam is provided, students can obtain a diploma or certificate if they pass said exam. The type of certificate that one obtains depends on the course. This information is available to the student on the website at all times. The student declares that he/she is aware of this when registering for a course.

Each exam is organized according to the rules and regulations set out below in such a way as to give students the opportunity to prove they have the required competences for the professional purpose they have in mind.

Article 3: Time and place of the exams

The student themselves decide when to take the exam and can schedule it via their online student profile. This should be done at least a week in advance. The application will be processed within 48 hours and becomes final when the student receives confirmation from the school. In the confirmation, they’ll find the details of the exam: date, location, time and any relevant information.

Up to 5 years after registering for the course, the student retains the right to take an exam. Within that time, no exam fees apply.

Article 4: Examinations for a protected profession

If the course relates to a government-regulated profession in the Netherlands, the student will take an exam at the Central Examination Board in Brussels. This is the case with:

Regulated professions: In that case, the student takes an exam at the Central Examination Commission in Brussels, in order to obtain the certificate with which one is entitled to practice said profession.

Secondary education: The student takes the exam at the Examination board of Secondary Education of the Flemish Community in order to obtain an official secondary education diploma. The student can take a mock exam at the school in preparation. The same conditions apply to the mock exam that apply to standard exams at the school.

Article 5: Remote exams

If the student is not physically able to come to the exam locations of the School, an exam can be remotely scheduled via Skype. For a remote exam via Skype, the student must comply with the following conditions:

  1. Visibility of the student

The student places themselves in front of a working web camera, so that his/her face is visible to the school examiner at all times

  1. Internet connection of the student

The student connects to a stable Internet connection via Ethernet to prevent the connection from being long

  1. Environment of the student

The student must be alone in the room they’re in during the exam. This requires the student to rotate the web came 360 degrees before the start of the exam to prove that they’re alone in the room. If the school’s examiner determines that one or more of the above conditions are not met or are met only partially, they can stop the exam and give the student a zero.

In the event that one does not pass the exam, they can always retake it. The re-exam is free.

Article 6: Conditions for taking exams

  1. Payment

Students can only participate in an exam if they’ve paid their tuition fees

  1. Per course requirements

Participation in an exam may be subject to certain conditions, such as the timely submission of papers. The school can determine that students who do not meet the conditions set receive a “fail” for the relevant course unit.

  1. Identity verification

During the exam, students must be able to prove their identity. Students must use a valid ID. If the student cannot provide a valid ID, the student will be marked absent for the exam.

Article 7: Catch-up exams

Students who registered for an exam but cannot take it must let the school know at least one working days in advance with a valid medical certificate or the necessary supporting documents in case of force majeure. Subsequently, the student can schedule a catch-up exam with the school at a later date. This can be done via the online student platform.

Article 8: Assignment submission deadline

If a specific deadline has been set for the submission os a paper, but students believe they can’t meet said deadline for a good reason, they must contact the school before the specified submission date.
The school may determine that, if the submission deadline is not respected, the paper will be considered not submitted and the student may receive a zero score on it.

Article 9: Examination format and duration

The teacher informs the students in advance of the details of the exam. These are determined based on the competences to be assessed. The exams can consist of written, oral or digital questions, or completing a practical assignment, depending on the specific program. Unless specifically stated otherwise, each exam takes place without the help of any written or digital references or aids.

Article 10: Audio and video recordings of the exam

The student agrees that video and audio recordings will be made during the exam in order to provide evidence in the event of a complaint or appeal procedure. The school can also use the recordings for internal quality purposes.

Article 11: Irregularities

Any student behavior that prevents correct evaluation of the planned competence goals(e.g cheating, plagiarism) is considered irregular behavior and entitles the school to stop the exam and automatically give the student a zero score. The student also loses the right to retake the exam in question.

Article 12: Mobile phone

During the exam, the student must switch off their mobile phone, smartphone or other electronic device, unless the use of said device is explicitly permitted by the subject teacher of the course the exam pertains to. If the student does not comply with this rule, the school retains the right to stop the exam and automatically give the student a zero score. The student then loses the right to retake the exam in question

Article 13: Grading scale

A full course unit is graded at 100%, and the result of an exam is expressed in percent only. The school may decide that a course unit or part of one will be graded in a pass/fail format. Any partial marks are converted by the subject teacher or by agreement between different teachers.

Article 14: Passing criteria

Students pass a course if they achieve a score of at least 60% during the competency examination. If the training program consists of theory and practice, then the student needs to score 60% on both components.

Article 15: Passing criteria for an all-round course

An all-round course consists of several courses. To pass an all-round training course, the student must achieve at least achieve a score of at least 60% during the competency examination. The student receives a diploma for each course unit, provided that they passed the exam. If the student has passed all courses, they also obtain an all-round diploma.

Article 16: Non-participation in an exam

If students fail to participate in an exam, they would be graded as “not present”.

Article 17: Loss of an exam

In the very exceptional scenario that the educational institution or the teacher loses the exam and the school is responsible for the loss of the exam, a new exam time will be scheduled in consultation with the student or the class. The details of the new exam are discussed with the student or class concerned.

Article 18: Announcing results

The members of the evaluation committee and all persons present at the evaluation are bound by absolute secrecy regarding the voting process. The subject teachers communicate the results as soon as possible after the exam via the student platform. You can immediately review your results and grade via the student profile. The diploma itself is mailed as soon as possible. The school is not responsible for any delay in mail carrier services.

Article 19: Discussion of results and right to feedback

The student has the right to review their exam alongside the teacher. They must request a feedback appointment at the school secretariat, if they have a valid reason. Nothing from the exam may be copied or taken out of the inspection room.

The school can decide to schedule a feedback appointment if the student has failed to pass the exam several times.

Article 20: Appeal period

If the student does not agree with their final grade, they have an appeal period of 14 calendar days(starting from the moment the exam results became available to them) to submit a registered complaint to the school. This complaint is then presented to a jury consisting a member of management, administration, and a senior lecturer. The decision of the jury may lead to the appeal being denied, a confirmation or the original decision, or a revision of the original decision.

Article 21: Re-examinations

Students can retake an exam as many times as they want, as long as they do not exceed the 5 year period (counted from the date of registration) and unless the school has determined that the student has cheated or failed to comply with exam regulations. If the student has not passed after 2 retakes, the school can consult the student and help them by adjusting their learning method.
